Wearable devices that measure brain wave are becoming increasingly popular, but behind this technology lies a serious privacy problem. Manufacturers collect sensitive data from the nervous system without the knowledge or consent of users and use it to train artificial intelligence models.

  • Users are not aware: Millions of people using brain wave headphones do not know that their devices send their EEG (electroensefalogram) data to companies; secret data transfer takes place in the background.

-AI is harvested for training: The collected brain data contains personal information such as sleep quality, focus, stress levels, and is transferred directly to machine learning models.

  • Incomplete mechanisms: Most users do not mention this data transfer in the contract or are very embedded; the clear informed consent principle is violated.

  • Straight space: Since there is yet a comprehensive legal framework covering biological and nervous data category such as brain data, companies can act relatively free.

This issue shows new limits of data privacy. The brain data is our most sensitive personal information—which is directly connected with our thoughts, feelings and mental condition. If the device manufacturers and AI companies can use this data without our control, users may potentially face the risk of discrimination, manipulation or identity theft.

Wearable technology sector is growing rapidly but can’t grow legal protections. The fact that individuals have solid protection against brain data is currently a mandatory step.
